Context
The Union Minister for Law and Justice introduced the Supreme Court (Number of Judges) Amendment Bill, 2026 in the Lok Sabha. The Bill seeks to replace the Ordinance promulgated by the President on 16 May 2026 and permanently increase the sanctioned strength of judges in the Supreme Court.
History of the Issue
The Supreme Court (Number of Judges) Act, 1956 empowers Parliament, under Article 124(1) of the Constitution, to determine the number of Supreme Court judges through legislation. The Court originally started with 8 judges (including the Chief Justice of India) in 1950. As litigation increased, Parliament periodically enhanced the sanctioned strength. The last revision was made in 2019, when the total strength was increased from 31 to 34 judges.
