1. Supreme Court Distances Itself from Changes to Form 6
The Supreme Court clarified that it had not directed or approved modifications to Form 6, used for enrolment of new voters, during the Special Intensive Revision (SIR) controversy. The clarification came while the Court considered petitions seeking action against CEC Gyanesh Kumar over allegations of bias, unilateral decision-making and procedural overreach. The Court did not suspend the CEC; instead, it issued notice and sought responses. It also examined the unusually broad statutory protection available to serving and former Election Commissioners for acts performed in official duty. The larger constitutional issue is how to reconcile ECI independence under Article 324 with accountability, judicial review and universal adult suffrage under Article 326. Gist: the Court’s position separates judicial supervision from the ECI’s administrative choices. Electoral-roll revision must protect roll integrity without creating arbitrary documentary barriers, while judicial intervention must preserve institutional continuity and the Commission’s constitutional independence.
2. Great Nicobar Project — Supreme Court Refuses to Stop High Court Proceedings
The Supreme Court declined to entertain the Union government’s challenge to proceedings in the Calcutta High Court concerning the Great Nicobar Island development project. The Centre had questioned the maintainability of petitions challenging aspects of the project, including alleged implications for forests, tribal rights and the island’s ecology. The Supreme Court noted that the matter was already pending before the High Court and therefore refused to interfere at this stage. Great Nicobar is environmentally sensitive and hosts tropical forests, coastal ecosystems and indigenous communities, while the government views the proposed port and associated infrastructure as strategically and economically important. The dispute therefore represents the classic development–environment–strategic security trilemma. Gist: large strategic infrastructure does not automatically displace environmental and constitutional scrutiny. Sustainable development requires cumulative-impact assessment, protection of tribal rights, scientifically credible clearances and judicial review while recognising legitimate national-security and connectivity objectives.
