1. CEC के फैसलों पर सुप्रीम कोर्ट की कसौटी: कानून टूटा तो निर्णय रद्द होंगे
मुख्य चुनाव आयुक्त (CEC) ज्ञानेश कुमार पर अन्य दोनों चुनाव आयुक्तों को दरकिनार कर SIR से जुड़े कुछ फैसले एकतरफा लेने के आरोपों पर सुप्रीम कोर्ट ने चुनाव आयोग और केंद्र को नोटिस जारी किया। चीफ जस्टिस सूर्यकांत की पीठ ने कहा कि रिकॉर्ड की जांच में कोई निर्णय कानून के अनुरूप नहीं मिला तो उसे रद्द किया जा सकता है। हालांकि कोर्ट ने अंतिम सुनवाई तक CEC को निर्णय लेने से रोकने या निलंबित करने का अंतरिम आदेश देने से इनकार किया, क्योंकि संबंधित पक्षों के जवाब और आयोग का रिकॉर्ड देखे बिना एकतरफा आदेश उचित नहीं होगा। चुनाव आयोग ने राहुल गांधी के Form-6 संबंधी आरोपों को भी भ्रामक बताते हुए कहा कि बिहार SIR में declaration जोड़ा गया था, Form-6 नहीं बदला गया। सार: मामला चुनाव आयोग की institutional independence के साथ collective decision-making, due process और judicial review की सीमाओं से जुड़ा महत्वपूर्ण संवैधानिक प्रश्न उठाता है।
