1. Supreme Court to quash FIRs against student protesters

The Supreme Court agreed to invoke its Article 142 powers to quash FIRs registered against students who participated in nationwide NEET-UG protests, while deciding to constitute a three-member committee to examine broader issues arising from student demonstrations. The police informed the Court that investigation would be confined to 2,873 persons with “serious criminal antecedents”, rather than ordinary protesters. The Court distinguished legitimate protest from criminal activity and emphasised that students gathered to express concerns about their future should not automatically be treated as criminals. The underlying constitutional logic balances freedom of speech and peaceful assembly under Article 19 with the State’s duty to maintain public order. Criminal law should target violence or identifiable offences, not become a deterrent against democratic dissent. The Court’s approach therefore favours proportionality, individualised assessment and protection of legitimate expectations. The larger governance lesson is that policing demonstrations must distinguish peaceful participation from unlawful conduct and avoid indiscriminate criminalisation of young citizens.
