1. Government to refer FCRA Bill to Joint Parliamentary Committee
Facing sustained opposition and concerns from civil-society and religious organisations, the Union Government has agreed to refer the proposed Foreign Contribution Regulation Act amendment Bill to a Joint Parliamentary Committee. Critics, including the Tamil Nadu Assembly and Christian organisations, fear that the proposed provisions could expand executive control over charitable institutions receiving foreign contributions. The government’s logic is to strengthen oversight so that overseas funds are not diverted for unlawful, political or security-sensitive purposes. Opponents argue that wide discretionary powers may create uncertainty for organisations engaged in education, healthcare, welfare and religious activity. Referral to a JPC represents an institutional compromise because it permits clause-by-clause scrutiny, expert testimony and broader political consultation before final legislation. The larger democratic stand should favour transparency and accountability without making regulatory compliance excessively burdensome. Financial oversight is legitimate, but restrictions must remain proportionate, reasoned and subject to judicial review so that regulation does not become a tool for curbing lawful civil-society activity.
