1. Supreme Court Examines Electoral Roll Revision: Constitutional Validity of Logical Discrepancies
The Supreme Court, while hearing petitions challenging the Special Intensive Revision (SIR) of electoral rolls in Delhi, clarified that it had not yet decided the constitutional validity of using “logical discrepancies” to scrutinise voter entries. A three-judge Bench headed by Chief Justice Surya Kant asked the Election Commission of India to consider allowing certain previously registered voters to submit enumeration forms despite the deadline having passed. The Court questioned whether automated discrepancies, such as spelling mismatches, unusual age gaps between parents and children, or family-size variations, could justify further verification without adequate human assessment. The Election Commission's position was that SIR procedures were intended to improve the accuracy of electoral rolls. However, the judges emphasised the importance of fair procedures and opportunities for affected citizens to respond. Constitutional significance: Article 324 concerns election supervision, while Article 326 establishes adult suffrage. Gist: Electoral integrity requires both accurate voter lists and safeguards against unjustified exclusion.
