1.     Supreme Court upholds SIR but limits its citizenship effect

The Supreme Court upheld the legal validity of the Election Commission’s Special Intensive Revision of electoral rolls, holding that the exercise supports the constitutional mandate of free and fair elections by ensuring accurate and reliable rolls. However, the Court drew an important boundary: deletion from the electoral roll cannot be treated as a final determination of citizenship. The Election Commission may conduct a limited, prima facie inquiry into citizenship only for electoral eligibility, but cases of persons deleted from the 2003 rolls must be referred to the competent authority under citizenship law within four weeks. The logic is a balance between clean voter lists and procedural fairness. The stand of the Court gives the EC operational legitimacy but prevents it from becoming a citizenship-deciding authority. The gist is that electoral integrity and citizenship rights must be kept institutionally distinct.
