SOURCES OF INDIAN CONSTITUTION
1. British Constitution
The British Constitution has greatly influenced the Constitution of India. India adopted the Parliamentary System of Government, where the Prime Minister and Council of Ministers are collectively responsible to the Parliament. The concept of Single Citizenship ensures equal citizenship throughout the country. India also borrowed the Rule of Law, meaning everyone is equal before the law, regardless of position or status. Other important features adopted include Parliamentary Privileges, the Legislative Procedure, and the principle of Equality before Law. These features ensure democratic governance, accountability of the executive, and protection of citizens' rights through a responsible and representative government.
2. French Constitution
The French Constitution inspired India's commitment to the ideals of Liberty, Equality, and Fraternity, which are reflected in the Preamble of the Indian Constitution. India also adopted the concept of a Republic, where the Head of State is elected rather than inheriting the position. The idea of justice, democracy, and popular sovereignty also reflects French revolutionary principles. In recent years, the concept of Goods and Services Tax (GST) has often been compared with France's value-added tax system. The French influence strengthened India's democratic values, emphasizing equality among citizens and the importance of constitutional governance.
3. Australian Constitution
The Australian Constitution contributed several important federal features to the Indian Constitution. India adopted the concept of the Concurrent List, where both the Union and State Governments can make laws on specified subjects. The language of the Preamble also reflects some Australian constitutional influence. Another major feature borrowed is the idea of cooperative federalism, promoting harmonious relations between the Centre and the States. Australia demonstrated how powers could be shared effectively in a federal system while maintaining national unity. These provisions help India balance central authority with state autonomy in a large and diverse democracy.
4. Irish Constitution
The Irish Constitution influenced several unique provisions in the Indian Constitution. India borrowed the concept of the Directive Principles of State Policy (DPSPs), which guide the government in promoting social, economic, and political justice. The method of the election of the President through an electoral college was also inspired by Ireland. Additionally, the provision allowing the President to nominate twelve members to the Rajya Sabha for their contributions to literature, science, art, and social service comes from the Irish Constitution. These features strengthen India's democratic governance and promote welfare-oriented administration.
5. Japanese Constitution
The Japanese Constitution inspired the concept of "Procedure Established by Law" in the Indian Constitution. This principle states that a person's life or personal liberty can only be restricted according to a law validly enacted by Parliament. Unlike the American concept of "Due Process of Law," this provision originally gave greater authority to the legislature. However, after judicial interpretation, particularly in the Maneka Gandhi case (1978), Indian courts expanded its meaning to ensure fairness, justice, and reasonableness. This principle balances individual liberty with the authority of the State under constitutional law.
6. German Constitution
India borrowed the Emergency Provisions from the Weimar Constitution of Germany. These provisions allow the government to take extraordinary measures during situations such as war, external aggression, armed rebellion, or constitutional breakdown in a state. During an emergency, certain powers of the Union Government increase to protect national security and maintain public order. At the same time, constitutional safeguards exist to prevent misuse of these powers. The Emergency provisions have been amended several times, particularly after the Emergency of 1975–77, to strengthen democratic safeguards and protect citizens' rights.
7. South African Constitution
The South African Constitution influenced India's method of Constitutional Amendment. India adopted a flexible yet balanced amendment process that allows constitutional changes while preserving stability. Certain provisions can be amended by a simple majority, others require a special majority in Parliament, and some need approval from at least half of the State Legislatures. This system ensures that neither the Constitution becomes too rigid nor too flexible. The amendment procedure allows India to adapt to changing social, political, and economic conditions while protecting the Constitution's basic structure and democratic principles.
8. United States Constitution
The United States Constitution is one of the most significant sources of the Indian Constitution. India adopted Fundamental Rights, ensuring civil liberties and protection against arbitrary government action. The concepts of an Independent Judiciary, Judicial Review, and the Supremacy of the Constitution also came from the United States. India borrowed the process of Impeachment of the President, the office of the Vice-President, and the concept of a written Preamble. These provisions strengthen democracy by protecting individual rights, maintaining constitutional supremacy, and ensuring that government actions remain within constitutional limits.
9. USSR Constitution
The Constitution of the former Soviet Union (USSR) inspired several welfare-oriented features in the Indian Constitution. India adopted the concept of Fundamental Duties, which remind citizens of their responsibilities towards the nation. The ideals of Social, Economic, and Political Justice also reflect Soviet influence and are included in the Preamble. The idea of Socialism, added through the 42nd Constitutional Amendment in 1976, aims to reduce inequality and promote social welfare. The concept of Five-Year Plans, though not constitutional, was also inspired by Soviet economic planning and guided India's development for several decades.
10. Canadian Constitution
The Canadian Constitution greatly influenced India's federal structure. India adopted a strong Centre with a federal system, ensuring national unity while allowing state governments to function independently. The concept of Residuary Powers, where subjects not listed in the Constitution belong to the Union Government, was borrowed from Canada. India also adopted the office of the Governor, appointed by the President to represent the Union in the states. The broad structure of the Goods and Services Tax (GST) also reflects elements of Canadian cooperative federalism. These features help maintain unity, coordination, and effective governance across India.
