RIGHT TO FREEDOM OF SPEECH AND EXPRESSION:
THE CORNERSTONE OF INDIAN DEMOCRACY
1. Introduction
Freedom of speech and expression is one of the most cherished freedoms in a democratic society. It is the foundation upon which democratic governance, political participation, public accountability, intellectual development, and social progress rest. Without freedom of speech, democracy becomes an empty formality because citizens cannot question authority, criticize government policies, exchange ideas, or participate meaningfully in public affairs.
Recognizing its significance, the framers of the Indian Constitution incorporated the Right to Freedom of Speech and Expression as a Fundamental Right under Article 19(1)(a). This right guarantees every citizen the freedom to express opinions, beliefs, thoughts, and ideas through speech, writing, printing, publication, art, cinema, digital communication, and other forms of expression.
The Supreme Court has repeatedly described freedom of speech and expression as the foundation of democratic governance. Over the decades, judicial interpretation has significantly expanded its scope while simultaneously balancing it against the reasonable restrictions permitted under Article 19(2).
2. Constitutional Foundation of Free Speech
Article 19(1)(a) provides:
"All citizens shall have the right to freedom of speech and expression."
