TEN CRITICAL QUESTIONS ON CURRENT GEOPLOITICAL AND NATIONAL ISSUES – 162
1. Should constitutional protection of peaceful protest depend on the identity or cause of the protesters?
Answer: No. Constitutional rights must operate consistently and impartially. The Supreme Court's relief to students protesting the NEET paper leak protects legitimate democratic dissent. However, the Indian Express editorial asks why similar proportionality should not apply to workers, farmers or anti-CAA protesters facing prolonged criminal proceedings. In my view, the State should distinguish peaceful protest from violence on the basis of individual evidence, not ideology or political convenience. Public order can legitimately be protected, but criminal proceedings themselves should not become punishment. A mature democracy is tested particularly by how fairly it protects dissent with which authorities may disagree.
