1. The Sole Dissenter
Justice Radhabinod Pal was the only judge among the eleven members of the Tokyo Trial who delivered a dissenting judgment. Appointed from British India, he disagreed with the tribunal’s basic approach and argued that the trial reflected “victor’s justice,” where the winning powers judged the defeated nation. Pal wrote a detailed dissenting opinion of over 1,200 pages, challenging the legal basis of the prosecution. He believed that the tribunal lacked fairness because similar actions by Allied powers were not examined. His dissent remains one of the most significant legal opinions in international judicial history and continues to be widely studied.
2. Critique of Imperialism
Justice Pal strongly criticized imperialism and colonialism. Influenced by India’s struggle against British rule, he argued that the Allied nations themselves had a history of territorial expansion and colonial domination. Therefore, he questioned their moral authority to judge Japanese leaders solely for actions connected to imperial ambitions. Pal believed that justice should be applied equally to all nations, regardless of whether they were winners or losers in war.
