JUDICIAL DELAYS IN INDIA: THE CHALLENGE OF DELIVERING TIMELY JUSTICE

Introduction

The administration of justice is one of the most important functions of a constitutional democracy. Courts protect rights, resolve disputes, punish offenders, and uphold the rule of law. However, justice can serve its purpose only when it is delivered within a reasonable time. Delayed justice often causes the same harm as denial of justice. This reality is captured in the famous legal maxim: "Justice delayed is justice denied."

Judicial delay has emerged as one of the most significant institutional challenges confronting India. Despite having an independent judiciary and a well-developed legal framework, millions of cases remain pending across various courts. The problem has reached such proportions that it now affects access to justice, economic development, public confidence in institutions, and the protection of fundamental rights.

As of 2025–26, the total pendency of cases in Indian courts has crossed 5.3 crore, with the overwhelming majority pending before subordinate courts. The backlog has become a systemic crisis requiring urgent and comprehensive reforms.
